Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Resume Builder mobile application (the "Service") operated by us ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Use of the App

Resume Builder is a tool designed to help you create and export professional resumes. You agree to use the app only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the app.

2. User Content & Local Storage

Our Service allows you to input text, graphics, and other material ("Content") to create resumes.

Local Storage: By default, your Content is stored locally on your device. We do not upload, store, or backup your resume data on our servers for standard resume creation. You are solely responsible for backing up your data.

AI Features Exception: If you use the AI Interview Coach or similar AI features, you acknowledge and agree that the text of your resume, your provided job titles, and your transcribed voice inputs will be temporarily transmitted to our backend and third-party AI providers (e.g., OpenAI) to generate the requested AI responses and feedback.

Data Loss: We are not responsible for any loss of data resulting from device loss, app uninstallation, or corruption of local storage.

License: You retain full ownership of any Content you create. By using the app, you grant us a limited license to process this Content on your device solely for the purpose of generating your resume documents.

3. AI-Generated Content Disclaimer

The Service provides access to an "AI Interview Coach" that generates simulated interview questions, answers, and performance evaluations. You acknowledge that:

• Not Professional Advice: The AI-generated content (including scores, feedback, and suggested improvements) is for informational and practice purposes only. It does not constitute professional career coaching, human resources advice, or a guarantee of employment.
• Accuracy: While we strive to provide realistic simulations using advanced artificial intelligence, AI models can occasionally produce inaccurate, incomplete, or repetitive information. We do not warrant the reliability or accuracy of the AI-generated evaluations.
• Voice Processing: Voice input (Speech-to-Text) relies on device native speech recognition services. Accuracy may vary based on accent, background noise, and device capabilities.

4. Subscriptions & In-App Purchases

Some parts of the Service are billed on a subscription basis ("VIP Services"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a weekly, monthly, quarterly, or annual basis, depending on the type of subscription plan you select when purchasing a subscription. The price and length of each subscription are clearly displayed in the app prior to purchase.

4.1 Payment and Auto-Renewal

For Apple users, payment will be charged to your Apple ID / iTunes Account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period. Your account will be charged for renewal within 24-hours prior to the end of the current period, and the cost of the renewal will be identified.

4.2 Managing Subscriptions and Cancellation

Subscriptions may be managed by you, and auto-renewal may be turned off by going to your Account Settings after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that publication, where applicable.

You may cancel your subscription renewal through your respective App Store settings:

• iOS: Go to Settings > [Your Name] > Subscriptions.
• Android: Go to Google Play Store > Menu > Subscriptions.

5. Intellectual Property

The Service and its original content (excluding Content provided by users and AI-generated text), features, and functionality are and will remain the exclusive property of Resume Builder and its licensors. The Service is protected by copyright, trademark, and other laws of both the country and foreign countries.

6. Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Resume Builder.

Resume Builder has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that Resume Builder shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

7. Limitation of Liability

In no event shall Resume Builder, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service, including any reliance on AI-generated feedback; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

9. Apple App Store Additional Terms

If you downloaded the Service from the Apple App Store, the following additional terms apply:

• Acknowledgement: You acknowledge that these Terms are concluded between you and us only, and not with Apple. We, not Apple, are solely responsible for the Service and the content thereof.
• Scope of License: The license granted to you for the Service is limited to a non-transferable license to use the Service on any Apple-branded Products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Maintenance and Support: We are solely responsible for providing any maintenance and support services with respect to the Service. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service.
• Warranty: In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service.
• Product Claims: We, not Apple, are responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service, including, but not limited to: product liability claims, failure to conform to legal requirements, and consumer protection claims.
• Intellectual Property Rights: In the event of any third party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
• Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third Party Terms of Agreement: You must comply with applicable third party terms of agreement when using the Service.
• Third Party Beneficiary: You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.
